These Terms of Service (“Terms”) govern your use of The Mix apps and website (the “Service”), operated by Ibis Applications, LLC. By using the Service, you agree to these Terms.
Eligibility
You must be at least 21 years old to use the Service. By using it, you confirm that you are of legal drinking age in your location. See our 21+ Policy.
Your account
You're responsible for the accuracy of your account information, for keeping your login secure, and for activity that happens under your account.
Check-ins, deals, and rewards
- Rewards and deals are offered by venues, not by The Mix, and are subject to availability, venue rules, and applicable law.
- Rewards have no cash value and may be limited (for example, one redemption per visit within a set window).
- Check-ins may be validated by location. Attempting to game check-ins or rewards — through false locations, automation, or other abuse — may void rewards and result in account suspension.
- We may add, change, or remove features, deals, or rewards at any time.
Your content
You keep ownership of the content you post. By posting it, you grant us a non-exclusive, worldwide license to host, display, and use it to operate and promote the Service. You're responsible for your content and confirm you have the rights to share it. Don't post anything unlawful, infringing, deceptive, or harmful.
Acceptable use
Don't misuse the Service — including fraud, harassment, scraping, reverse engineering, interfering with the Service, or violating any law.
Venues
Venues are responsible for their own listings, offers, and accuracy, and may be subject to separate venue terms. The Mix is not responsible for a venue's offers or conduct.
Disclaimers
The Service is provided “as is” and “as available,” without warranties of any kind to the fullest extent permitted by law.
Limitation of liability
To the fullest extent permitted by law, The Mix and Ibis Applications, LLC will not be liable for indirect, incidental, or consequential damages arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us, if any, in the twelve months before the claim.
Termination
You can stop using the Service at any time. We may suspend or terminate access if you violate these Terms or misuse the Service.
Governing law
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. You agree that any dispute relating to the Service will be resolved in the state or federal courts located in Texas.
Changes to these Terms
We may update these Terms from time to time. We'll post the updated version here and revise the date above. Continued use after changes means you accept the updated Terms.
